1. Introduction

These terms and conditions ("Terms") govern your use of Zethu Community Projects (“Provider”) website under the domain name (www.zethucommunity.org.za) ("Website") and donor privacy in participation in empowering young creativity through (sustainable Cultural Arts Projects) for underprivileged youths and children to promote artistic expression, skills development, and social growth.

2. Definitions

"We" or "Us" refers to Zethu Community Projects.
"You" refers to “donor” the user of our Website.
"Projects" refers to our skills development initiatives for underprivileged youths and children.

3. Use of Website

You must be at least 18 years old to use our Website.
You agree to use the Website for lawful purposes only.
You must consent and acknowledge to any and all agreements, notices, disclosures, or any other communication, satisfies any legal requirement.
You are required to put such communications in writing.

4. Donor Privacy policy

The private information required for processing of donations or contributions using the e-commerce facility, namely the User’s personal information; credit card details and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties.
The Provider shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). 5. Donation Options Accepted

Donations may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Provider's bank account, the details of which will be provided on request.

6. Card Acquiring and Security

Card transactions will be acquired for the Provider via Ozow (Pty) Ltd, an approved payment gateway for all South African Acquiring Banks. No Card details are stored on the website. Users may go to www.ozow.com to view their security certificate and security policy.

7. Donor Details Separate From Card Details

Donor details will be stored by the Provider separately from card details which are entered by the donor on Ozow’s secured site. For more detail on Ozow refer to www.ozow.com

8. Merchant Outlet Country and Transaction Currency

The merchant outlet country at the time of presenting donation options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

9. Refund Policy

- The Website allows you to make donations or contributions to support our skills development projects, empowering young creativity through (sustainable Cultural Arts Projects).
- Donations are Non-refundable, as they're used directly to support our skills development projects for underprivileged youths and children

10. Delivery Policy

- Our projects are delivered in-person, depending on the specific initiative.
- We'll provide confirmation of project details, including dates, times, and locations.
- We're committed to delivering high-quality projects, but circumstances may require changes;
- We will notify both beneficiaries and donors promptly.

11. Intellectual Property

- All content on the Website is owned by Zethu Community Projects or our affiliate or our subsidiary of the Provider and our partners.
- You are not allowed to reproduce or distribute our content without permission.

12. Limitation of Liability

The Website and all Content on the Website, including any current or future offer of projects, transaction or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof.

13. Governing Law

These Terms and Conditions is governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Pretoria High Court in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between the Provider and the User with regard to the use of the Content and this Website.

17. Country of domicile

This website is governed by the laws of South Africa and Zethu Community Projects chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, South Africa.

15. Changes to Terms and Conditions

Provider reserves the right to change, modifies, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates. We may change these Terms at any time.
